Iran's nuclear programs and its proximity to other nations with similar initiativesnecessitate addressing potential liabilities from nuclear accidents. However, Iran faces legalobstacles in accessing the Vienna Convention on Civil Liability for Nuclear Damage dueto inconsistencies with its domestic legal framework. Challenges include the convention'simposition of strict liability on nuclear operators, diverging from Iran's old-based system,and establishing compensation mechanisms for nuclear incidents. Other contradictions alsoexist, including liability insurance and specifi c minimum standards for fi nancial protectionagainst damage. Currently, because Iran has not ratifi ed international conventions on civilliability for nuclear damage, these conventions cannot be enforced in the event of an incidentin Iran. Additionally, Iran's domestic laws, which encompass general rules of civil liability,are inadequate for compensating nuclear damage. Th erefore, substantial legal reforms areneeded to comply with the convention's mandates, hindering Iran's complete alignment.Th e Iranian draft law on civil liability for nuclear damage, proposed by the Atomic EnergyOrganization of Iran, holds the potential to serve as an instrument for overcoming theselegal challenges in Iran, off ering hope for a resolution.
