One of the most topical and often discussed international legal issues at the moment is the legal consequences of the Russian aggression against Ukraine. It has been discussed from various perspectives, including that of jus cogens. In addition to issues of the international criminal responsibility of those responsible for the preparation, initiation and conduct of an offensive war and of the application of international sanctions against Russia and Russian entities, this involves reparation for damages caused in Ukraine as a result of Russian aggression. Moreover, the questions of conflicts of norms, includingyAi cogens, and the responsibility of states are among the lifelong research interests of Professor Wladyslaw Czaplinski. The aim of this contribution is to look into the question of a possible mechanism of compensation for damages. General international law regulates the principles of states' responsibility for internationally wrongful conduct, which includes full reparation for damage. The current status is captured in the codification of Articles on the responsibility of states for internationally wrongful acts (ARSIWA), adopted by the UN International Law Commission in 2001.
