    Within the Czech legal framework extended confiscation operates under a general premise, which is the reduction of the standard of proof required for confiscation. This feature distinguishes it significantly from all institutes of Czech criminal law. Extended confiscation is not mandatory even if the legal conditions for its imposition are met. The legislative foundation of extended confiscation in the Czech Republic, as articulated, does not explicitly refer to the term &apos;extended confiscation&apos;, yet it embodies the spirit and intent of EU Directive 2014/42/EU.The extended confiscation was adopted with the expectation that it would make the fight against crime easier, but there are some controversies and questions associated with it in the Czech law and legal practice. Firstly, extended confiscation can be used against persons other than the accused, and it can happen on the basis of a petition made at the very final stage of the proceedings. In such case these persons cannot participate adequately in the proceedings and defend their rights. Secondly, victims of crimes that come to light in the future have no right to satisfy their claims from the confiscated property. In practice, this means that the State can cause their claims unenforceable.It is clear that extended confiscation has its place in Czech law and contributes to fight against crime. However, its half-baked implementation still entails unnecessary risks of unjust interference with rights of affected persons, including those who have never been convicted of anything (victims or third parties).
