    The Constitutionalization and the Europeanization of Private Law in the Czech Republic

    For a long time, the development of private law was exclusively linked to the development of individual national legal orders, to their values and historical traditions. A change took place especially after the Second World War, when the concept of fundamental human rights and their protection within the constitutional order began to take hold, as well as the idea of European integration, which in terms of scope and intensity had far outgrown its originally intended contours. The chapter first discusses in general terms the fundamental human rights in the constitutional order of the Czech Republic and its relation to private law. The next part of the chapter is focused on the details of the constitutionalization of private law in the case-law of the Constitutional Court of the Czech Republic. Furthermore, attention is paid to the Europeanization of private law in the Czech Republic. The analysis of the individual sub-topics and their impact on private law clearly show that private law rules are currently very intensively influenced both by the impact of constitutional law and by the phenomenon of Europeanization. The development and further heading of private law in the Czech Republic can no longer be considered only in isolated, purely national contexts.
