    Although international criminal justice has become part of the mainstream of international law theory over the past 30 years, the international community has never faced the challenge of creating a tribunal to prosecute the crime of aggression during this period. Indeed, all of the international or mixed criminal tribunals that have been established since the first half of the 1990s have had their subject matter jurisdiction limited to the crime of genocide, crimes against humanity, and war crimes, or only some of them, or also to certain other serious crimes under international or domestic law. By contrast, the crime of aggression, under the older name the crime against peace, was first and last tried internationally before the international military tribunals at Nuremberg and Tokyo, established immediately after World War. According to the opinion of the Nuremberg Tribunal, &quot;those who wage aggressive war are doing that which is equally illegal, and of much greater moment than a breach of one of the rules of the Hague Convention&quot;, It is interesting that the Nuremberg definition of the crime against peace includes the term &quot;war of aggression&quot; but it was left completely undefined, despite the effort of Justice Robert Jackson in London.
