Methodology of Law and Methodology of Legal Scholarship in the Czech Republic
Popis výsledku v původním jazyce
The chapter presents the most significant methodological courses currently taughtat the Faculty of Law of Charles University in Prague. Attention is paid both to themethods taught and to the most important publications used for their study, bothin relation to the methodology of law and to the methodology of legal scholarship. This is followed by a content analysis of the Czech discourse regarding the methodology of law. In this context, the authors introduce the most debated issues thathave resonated in the Czech legal environment over the last three decades, i.e. fromthe fall of communism in 1989 until today. Then, the focus shifts to Czech legalscholarship, and more specifically, what approaches and methods have been used inCzech legal scholarship since its inception in the 19th century, both in law theorydisciplines and in legal-dogmatic fields. An important part of the chapter is an analytical-empirical examination of the current views of representatives of Czech legaldoctrine regarding the role of methodology in legal research. The analysis of therelevant literature and the results of a questionnaire survey among Czech legal theorists prove the topicality and open nature of these discussions. Thereby, the methodology of law itself is internally being divided into the methodology of law-makingand the methodology of its application. The methodology of legal scholarship isthen linked with procedures aimed at obtaining correct and true knowledge of thelaw. The authors examine both the differences between and the common aspectsof these two methodologies. They also identify methods appearing exclusively inlawyers' methodological catalogues.
