In Recital of the Directive 2005/29/EC there is stated: The penalties must be effective, proportionate and dissuasive. The reference to dissuasive function of penalties is missing in the Directive 114/EC. One can then claim that penalties for unfair actions between competitors should be that much dissuasive in order to suppress some natural characteristics of economic competition.
