Refusal of Recognition of Judgements in Civil and Commercial Matters Based on Public Order in European Judicial Area – Can We Define European Public Order?
Popis výsledku v původním jazyce
The principle of mutual recognition of judgements in civil and commercial matters is one of the most important elements based on which European Judicial Area is established. This principle is based on mutual trust between individual EU Member States that can trust each other that they are capable to ensure fair trial and access to justice to all people. However, mutual trust between EU Member States is not infinite. Based on restricted list of reasons, EU Member States can refuse to recognize judgements of other EU Member States in civil and commercial matters. One of these reasons is conflict with public order. The aim of this paper is to describe European public order as phenomenon in EU law and its application in connection to refusal of recognition of judgement in civil matters in European Judicial Area.
