In dem Beitrag werden wir uns mit dem Verhältnis von Menschenwürde und Lebensrecht beschäftigen. Beide Begriffe spielen eine zentrale Rolle in der Theorie und Praxis des Menschenrechtsschutzes. Wir möchten zeigen, dass die Rechtsbegründung der Anwendung von neuen biomedizinischen Technologien zur Entkoppelung von Menschenwürde und Lebensrecht führen. Als Beispiel kann man die heutigen Debatten über die Anwendung der neuen nichtinvasiven Methoden der pränatalen Diagnostik anführen. Die Vertreter der herrschenden Meinung finden diese Methoden nicht als eine Verletzung der Menschenwürde, obwohl es um das Lebensrecht ungeborener menschlicher Lebewesen geht. Kurz gesagt, nicht jede Verletzung des Lebens ist im heutigen rechtstheoretischen Diskurs als ein Verstoss gegen Menschenwürde verstanden. Das Ziel des Beitrages ist es zu bestätigen, dass eine effektive Menschenrechtsschutzstrategie nur von einem engen Zusammenhang zwischen Menschenwürde und Lebensrecht ausgehen muss.

The paper deals with the relationship between human dignity and right to life. Both terms play a central role in the theory and practice of human rights protection. The paper shows that the legal justification of the application of new biomedical technologies lead to the decoupling of human dignity from right to life. As an example, one can lead today's debates on the application of the new non-invasive methods of prenatal diagnosis. Representatives of the prevailing opinion see these methods as a violation of human dignity, although dealing with the unborn human beings right to life. In short, not every violation of life is understood as a violation of human dignity in today's legal-theoretical discourse. The objective of the contribution is to confirm that an effective human rights protection strategy must come only from a close connection between human dignity and right to life.
