Příspěvek se zabývá problematikou uplatňování nejlepšího zájmu dítěte v řízení o vyhoštění jeho rodičů, jakožto občanů třetí země, tedy nikoli občanů EU. Cílem příspěvku je zejména nastínit, jak se k posuzování nejlepšího zájmu v řízení o vyhoštění cizince, jehož děti legálně pobývají na území členského státu EU, staví judikatura, a to jak judikatura českých soudů, tak judikatura vrcholných evropských instancí (ESLP a SDEU).

The paper deals with the issue of applying the best interests of the child in the management of deportation of his parents, as citizens of a third country, ie not EU citizens. The aim of the paper is to outline how the assessment of the best interest in the management of deportation of a foreigner whose children are legally resident in the EU Member State is addressed by case law, both the case law of Czech courts and the case law of top European institutions (ECtHR and CJEU).
