Der Beitrag beschaftigt sich mit dem Verhaltniss zwischen materieller und formeller Auffassung der Straftat.Es wird dabei nicht nur die aktuelle tschechische Rechtsregelung analysiert, ihre Vorteile und Mangel,sondern auch die historische Entwicklung dieser Regelung.Man kommt zur Schlussfolgerung,dass die formelle Auffassung die Besonderheiten und Grundsatze der Strafverantwortung besser berusksichtigt. In diesem Zusammenhang werden werden die einzelnen Aspekte der materiellen Auffassung der Straftat erortert.

This presentation deals with relation between formal and material conception of the crime. It analyses the prezent Czech criminal Law regulation,its merits and negations. The autors conclusion is that the formal conception better reflects peculiarities of criminal responsibility. In this connection, this article givs explanation about the new codification of substantive Czech criminal Law with regard to the new formal conception of the crime.
