Die grüne Transformation fordert alle Rechtsgebiete und damit auch das Beihilferecht heraus, und die staatlichen Zuwednungen spielen immer größere Rolle in diesem Wandel. Die Wirschaftspolitik versucht oft diverse Ausgaben mit ihrem Beitrag zur klimagerechten Reform zu rechtfertigen. Diese sozialgestaltende Funktion verlangt jedoch eine Bilanz der Gesamtwirkung. Der Beitrag versucht die Problematik der beihilferechtlichen Grünfärberei aufgrund der Förderung der Elektromobilität zu demonstrieren. Zum Schluss wird es skizziert, wie die klima- und uweltbelastenden Wirkungen eines Projkets im Rahmen der Beihilfegenehmigung geprüft werden könnten.

The green transformation is challenging all areas of law, including state aid law, and state subsidies are playing an increasingly important role in this change. Economic policy often tries to justify various expenditures with its contribution to climate-friendly reform. However, this social shaping function requires an overall impact assessment. The article attempts to demonstrate the problems of greenwashing under state aid law due to the promotion of electromobility. Finally, it outlines how the climate and environmental impact of a project could be assessed in the context of state aid approval.
