Leider hat die Frage nach dem Wesen und der Stellung des Prozessrechts in der Rechtsordnung in der Rechtswissenschaft nur marginale Beachtung gefunden. Der Autor versucht, die Überlegungen von František Zoulík zu diesem Thema aufzugreifen und weiterzuentwickeln. Er untersucht Zoulíks provokante These von der Eigenständigkeit des Verfahrensrechts als eines Rechtsgebiets, das sich sowohl vom Privatrecht als auch vom öffentlichen Recht unterscheidet. Er kommt zu dem Schluss, dass die Besonderheit des Verfahrensrechts seine einfache Unterordnung als Zweig des öffentlichen Rechts verhindert.

Unfortunately, the question of the nature and position of procedural law in the system of law has received only marginal attention in legal scholarship. The author attempts to build on and further develop the ideas of František Zoulík on this topic. He examines Zoulik's provocative thesis on the separate nature of procedural law as a field of law distinct from both private and public law. It concludes that the characteristic of procedural law prevents its simple subordination as a branch of public law.
