Der Grundsatz der Willensautonomie im Zivilprozess spiegelt sich im Verfügungsgrundsatz wider. Der Autor untersucht, inwieweit es dem Gesetzgeber gelungen ist, ihn in unserer Gesetzgebung durchzusetzen. Er kommt zu dem Schluss, dass im Bereich der Disposition über das Verfahren und dessen Gegenstand Beschränkungen bestehen, die mit dem Recht auf rechtliches Gehoer unvereinbar sind.

The principle of autonomy of will in civil proceedings is reflected in the principle of disposition. The author examines to what extent the legislator has succeeded in enforcing it in our legislation. He concludes that restrictions persist in the area of the disposition of proceedings and their subject matter which are incompatible with the right to judicial protection.
