Chief justices and democratic resilience: Judicial leadership in times of constitutional crisis

This article introduces a symposium examining the role of chief justices in sustaining—or undermining—democratic resilience during periods of constitutional crisis. Moving beyond traditional accounts of judicial independence and accountability, the authors develop a tripartite framework of judicial leadership, distinguishing between jurisprudential, administrative, and representational powers. Drawing on comparative case studies from democracies under stress, the article shows how chief justices operate as pivotal institutional actors whose leadership can either resist democratic backsliding or facilitate authoritarian consolidation. The analysis highlights how leadership capacity is shaped by institutional design, appointment mechanisms, personal characteristics, historical legitimacy, and domestic and transnational support structures. In doing so, the article reframes judicial legitimacy as a dynamic construct that is actively produced through leadership practices, particularly in contexts where courts face sustained political attack.
