    The article examines the limitations of the Czech custody justice system, focusing on parental custody disputes and the impact of traditional patriarchal professional stereotypes. Drawing from in-depth interviews with legal professionals and experts, it elucidates the intersecting social, legal, and systemic factors contributing to the system’s failure in seeking consensual solutions post-divorce or separation. The article starts by highlighting entrenched societal perceptions wherein divorce is deemed a failure, leading to a blame-driven environment and a preference for court intervention rather than dialogue between parents. The article highlights legal barriers, revealing how custody categorisation sparks debates and intensifies conflicts, often hindering the promotion of joint custody and complicating parental responsibilities. It emphasises the role of the Office for Social and Legal Protection of Children (OSPOD), advocating for a shift from its current extensive role to a focus on mediating parental disputes, urging a child-centric approach. Furthermore, the piece critiques inadequate involvement of the child in decision-making processes, advocating for a more inclusive mechanism that considers children’s perspectives and needs as integral to custody decisions. The article emphasises the necessity for a multidisciplinary approach to challenge stereotypes, biases, and professional norms, stressing the importance of diverse expertise, collaboration, and parental and societal education regarding the significance of consensual resolutions in order to safeguard the child’s best interest. In conclusion, the article calls for transcending traditional gender and professional roles, exposing biases inherent in the custody justice system, and advocates for a child-centric approach to transform the custody justice system towards more consensual and holistic approach.
