Protective elements contained in the codes enacted in the early 19th century are discussed, namely in the Kniha práv nad přečiněními hrdelními a těžkými řádu městského, (totiž policye) přestupky (Penal code), issued in 1804, and the General Civil Code enacted in 1811. The protection provided by the codes applied to children both already born and not yet born, legitimate and illegitimate. Childern under the agy of seven enjoyed the best protection. Both codes distinguished between the legitimate and theillegitimate children; those born out of wedlock enjoyed fewer rights that the legitimate children, and the sentence for abandoning or killing such children was lower; yet these laws guaranteed to all children the right to protected life, the right to nourishment, education, and the protection of health. In the case of ill-treatment, the children could be removed from the family, but his/her next education failed to be specified.
