Th e Post-Lisbon EU embraces the Europe 2020 strategy, which endorses smart, sustainable, and inclusive growth in the single internal market. Th e consumer protection against unfair commercial practices in this market has been, already for one decade, subject to a full harmonization via the Unfair Commercial Practices Directive, UCPD. For a myriad of reasons, including national particularities and the balance of priorities, this move from minimum to full harmonization was and remains controversial. Th erefore, it is highly illustrative to research, analyze and assess the full harmonization eff ect of the UCPD in light of the Europe 2020 strategy, while exploring both primary and secondary sources of a multidisciplinary nature, including the case law of the Court of Justice of the EU. For seven years, the Europe 2020 and UCPD have been co-existing, so what kind of co-existence is that? Does the UCPD, with its full harmonization eff ect fi t in Europe 2020 or is it rather contra-productive with respect to smart, sustainable and inclusive growth?
