Commercial Terms in Bank Contracts after Recodification of the Czech Civil Law

Most likely on 1.1.2014 will become reality the most significant change on the field of private law in the modern history of the Czech Republic. At this date, New Civil Code, act no. 89/2012 Coll., Civil Code (hereinafter NCC), will come into force. In addition to the new principles, it brings also new terminology, changes of content of existing terminology and major changes in the area of contract law. The fundamental conceptual change is abolition of the so-called duality of obligations, still contained both civil and commercial code and its replacement by uniform rules in part IV of the NCC, called the relative property rights. As a result of revocation of the Commercial Code, also banking contracts have been moved into NCC. It is for these contracts typical to refer to detailed arrangements in commercial terms. The presented article deals mainly with the new legislation of commercial terms with regard to their use in banking contracts.
