Key Legal Instruments for Managing Extraordinary Situations and States in the Conditions of the Czech Republic

This article analyses at the same time valid and effective legal instruments, which stand in the hierarchy of legal regulations intended to manage extraordinary (crisis) situations and states at the top of the imaginary pyramid of legal regulations arranged on the principle of construction according to their legal force. It therefore pays attention to the Constitution of the Czech Republic and the Constitutional Act on the Security of the Czech Republic. The outlook is supplemented by a legal regulation at the level of the ordinary law, the crisis law, defining the basic parameters for the state of danger. After the floods that affected the Czech Republic in 1997, there was a period of relative absence of extraordinary situations and states. Discussions on the clarity, coherence and timeliness of the legal regulation of extraordinary situations and states have receded into the background. However, the spread of coronavirus SARS-CoV-2 and the subsequent worsening of the epidemic situation will certainly be an accelerating factor for a comprehensive analysis of the quality of legal instruments designed to manage extraordinary situations and states, their functional interaction and balance with a number of other measures to maximise the resulting synergy effect.
