The aim of this contribution as indicated by its title is to assess the question of whether allegations of disciplinary and administrative offenses can be classified as a "criminal charge" within the meaning of Article 6 of the European Convention on Human Rights i.e. whether the requirements arising from the right to a fair trial also apply to disciplinary proceedings and proceedings concerning the imposition of administrative measures. The authors primarily seek answers to these questions in the case law of the European Court of Human Rights (ECtHR) and, subsequently, in the jurisprudence of Czech courts.
