The aim of this article is the empirical verification on the significance of key driving force of the shadow economy on the shadow economy development in 28 European Union (EU) member countries from 2000 to 2014. Based on the estimation of panel data regression model was proved that to increase in the size of the shadow economy in the EU contributes especially high unemployment rate and a high level of regulation of the official economy (measured by the ratio of government expenditure to GDP). It has also been shown that for decrease in the size of the shadow economy in the EU has the greatest significance low level of corruption, economic growth, better government effectiveness and better rule of Law. One percent increase in the Corruption PerceptionIndex leads to a fall of the size of the shadow economy by around 0.18 percentage points, one percent increase in the Rule of Law indicator leads to a fall of the size of the shadow economy by around 0.52 percentage points and one percent
