Competency to Legal Acts in Seniors With Mental Disorders

Introduction: Competency to legal acts may be changed in acute or chronic psychiatric disorders, such as schizophrenia, mental retardation, psychoactive subtance intoxication, delirious states or dementia. Consequences of acts done in such psychiatric states may be severe, from aggression to financial loss or juridical problems. In case of incompetency (partial or total loss of competency to legal acts) there is supportive measure for coping legal problems as a result of imcompetency called guardianship. Guardianship is a legal measure to protect individuals with damaged capacity to manager their own affairs. As the population is getting older all over the world, increased incidence of dementia and other chronic mental disorders leading to the loss ofcompetence is expected. As a consequence, guardianship and its ethical, juridical, social aspects remains a challenge for near future. Aim: Main aim of the study is to determine prevalence of juridical incompetency in mentally ill seniors
