Internationales Privatrechtrecht soll Verhältnisse zwischen bestimmten Subjekten regeln, innerstaatliches Recht die Beziehungen der Individuen untereinander und zum Staat, Völkerrecht das Verhalten der Staaten untereinander. Ohne Staat kommt dieser Begriff von Recht im Allgemeinen und Völkerrecht im Besonderen nicht aus.Ob völkerrechtliche und privatrechtliche Einzelerscheinungen schon in Urgesellschaften vorzufinden oder erst beim Aufeinandertreffen von Großimperien (im Vorderen Orient) anzunehmen sind, hängt von der Definition, eng oder weit, ab. Hinzukommt, dass man für die Einordnung dieser frühen Phänomene in unsere moderne Gedankenwelt auf die archäologischer Funde angewiesen ist, aber auch dann muss man Zusammenhänge der Rechtsgebite einer rechtlichen und philosophischen Analyse unterwerfen.

The Article deals with historical concepts of international law. History of international Law is combined with treaties; treaties can be traced back thousands of years. Early examples of treaties include around 2100BC an agreement between the rulers of the city-states in Mesopotamia, inscribed on a stone block, setting a proscribed boundary between two states. If it is history of international Law or international private Law depends on philosophical and historical analysis.
