This working paper might provide more questions than answers because it is concerned with a highly complex issue of interpreting the European Convention for the Protection of Human Rights and Fundamental Freedoms. Particularly, it focuses on clash of three interpretational approaches - originalism and evolutive interpretation which might get further mixed up by the margin of appreciation doctrine. All this is analyzed from the perspective of national court asking - how should I interpret the Conventionin the instant case? It is a working paper of a part of an article I am preparing on this issue.
