Nach dem Zerfall des kommunistischen Ostblocks in Europa haben sich alle Vertreter der Fachöffentlichkeit sehr bald auf der Notwendigkeit der neuen Kodifikationen des Privatrechts geeinigt. Überraschenderweise sind nicht in vielen Ländern die entsprechenden Kodifizierungen durchgeführt worden. So wurde eine historische Möglichkeit, eine Zusammenarbeit in den ehemaligen Ostblockländern zu nutzen, leider versäumt. Paradoxerweise hat die europäische Integration zu der Kooperation nicht so beigetragen wie man gehofft hatte. Als erstes postkommunistisches Land hat Ungarn das Bürgerliche Gesetzbuch neu vorbereitet. Seine Existenz war aber nicht problemlos. Es wurde sogar vor dem Verfassungsgerichtshof angegriffen. Die Tschechische Republik steht als zweite in der Reihe vor Polen und Slowakei. Alle Vorbereitungsarbeiten, Diskussionen und Analysen sind sorgfältig durchgeführt worden und es bleibt nun lediglich die Hoffnung, dass die Einführung und Existenz des neuen Bürgerlichen Gesetzbuches d

After the collapse of the communist bloc in Europe all members of the scientific community agreed on the need of a new codification of private law. Surprisingly, the corresponding codifications have not been conducted in many countries. Unfortunately that historic opportunity to use cooperation in the former Eastern Bloc countries failed. Paradoxically, European integration has not contributed to the cooperation as had been hoped. Hungary, as the first post-communist country has prepared the new Civil Code. But its existence was not without problems. It was attacked even before the Constitutional Court. The Czech Republic is the second in the series before Poland and Slovakia. All preparatory work, discussions and analyzes have been carried out carefully and it now remains only the hope that the introduction and existence of the new Civil Code will not adversely affect the political situation.
