Consensus on HumanNature? The Concept of European Consensus in the Case-law of the Court in Strasbourg.

To interpret the European Convention on Human Rights as a "living instrument", the European Court of Human Rights (hereinafter " the Court" or "ECtHR") resorts to the the consensual technique of interpretation and bases its argumentation on common values accepted by the majority of contracting parties of the Council of Europe. This concept of European consensus is however questioned as it cannot be used for all societal situations. The article presents the basic hallmarks of the origin of the European consensus and areas where it is used by the Court. It develops further the concept of human dignity to show that this concept might be a limit concept to differentiate what areas are to be subject to the European consensus and what cannot be changed trough this technique.
