General features and legal development of the housing situation in the Czech republic

Divided ownership gives rise to a number of problems. Its manifestations include the existence of residential co-ownership. Residential co-ownership is a type of “real co-ownership”, where the owner of flat as a real part of the building is a co-owner of what is left of the building after we “remove” all the residential units. However, the owner has an undivided share in these common parts – unlike in the case of a flat. This creates potential ground for disputes. The form of residential co-ownership is affected by various factors, the most prominent being the national housing policy. The frequency, popularity, and the problems of the residential co-ownership are influenced by the activities of the States and other actors, which ultimately shape the national housing policy. This paper addresses its genesis and main features.
