This contribution discusses recent judgements of the European Court of Human Rights in the Delta Pekárny case and of the Court of Justice of the EU in the Deutsche Bahn Case, concerning on-site inspection performed by competition authorities, and analysis their consequences for future, as the courts found infringement of fundamental rights in both the cases.
