Inheritance contract has been brought back to Czech legislation by the current Civil Code after more than sixty years. In our territory it was last regulated by the General Civil Code, though its notion was rather different from the current one. The current regulation still preserves the basic features of inheritance contract as the most powerful inheritance entitlement. Strong position of inheritance contract stems from its nature as a two-sided legal conduct whereby the decedent calls the other contracting party for heir, and the other party accepts that. It is in particular for its nature that inheritance contract was in the past a frequent target of criticism, when under Roman law it was called “raven contract” (or greedy contract) that contravenes good morals, for it speculates with the death and denies the rule of autonomy of the decedent´s will. Therefore some current European civil codes refuse inheritance contract for similar reasons. The following text deals with historical conception of this institution, comparison thereof with current legislation, and in relation with the previous, the text points out problematic aspects of inheritance contract.
