This paper deals with the influence of the Charter of Fundamental Rights of the EU on the processes of constitutional review within Hungary and specifically analyses the approach of the Hungarian Constitutional Court (HCC) to the Union’s fundamental rights catalogue. The basic starting point for examining the impact of the EU Charter on constitutional review in Hungary is the general approach of the HCC to the applicability and impact of EU law in national legal practice. The HCC's approach in the past period was defined as reserved and minimalist (described by the concept of ‘restraint and seclusion’). The aim of this paper is to examine whether the presence of the EU Charter as binding EU law has brought or has the potential to bring about certain alterations and reversals of the general approach described and whether there is room for a proactive approach. The authors argue for this active role and suggest a shift towards a certain form of ‘resourceful engagement’ in relation to matters of fundamental rights protection involving the EU Charter.
