The approach of Czech courts to the judicial review of on-site inspections, performed by the Czech Competition Authority on the undertakings’ business premises, seemed to be settled after the amendment of the Czech Competition Act in 2016, reacting to the judgement of the European Court of Human Rights in the DELTA PEKARNY case in 2014. The situation however changed again in 2018, when the Constitutional Court removed any practical time limitation for challenging the inspection.
