Der ordre public und seine Rolle im negativen Sinne ist als ein präventives Instrument der Ultima Ratio zu verstehen. Er ist für die Sicherung der Stabilität des nationalen Rechtssystems nötig und wichtig für den Schutz der anerkannten Grundwertungen und Prinzipien im Rahmen des betroffenen Forums. Vielleicht weil diese Doktrin unter dem Einfluss rechtspolitischer Aspekte sehr oft an einer gewissen Amorphie leidet, lohnt es sich heute, die unterschiedliche Bedeutung des ordre public im traditionellen europäischen Verständnis und die Situation in China und in Ländern des islamischen Rechtskreises zu vergleichen.

Ordre public and its role in the negative sense should be understood as a preventive instrument of the Ultima Ratio. It is necessary to ensure the stability of the national legal system and important for the protection of recognized basic values and principles within the framework of the forum concerned. Perhaps because this doctrine very often suffers from a certain amorphism under the influence of legal policy aspects, it is worthwhile today to compare the different meanings of public policy in the traditional European understanding and the situation in China and in countries of the Islamic legal system
