The chapter focuses on the principle of impartiality of public administra- tion and its guarantee in the conditions of the legal system of the Czech Republic. Although such attributes as independence and impartiality are mostly associated primarily with the judicial power, impartiality is key also for the executive power, i.e. for the public administration. Even if the pub- lic administration (with exceptions) does not possess the characteristics of independence, its impartiality is, on the contrary, a necessary condition for its performance in any democratic state governed by the rule of law. It is in- admissible for an official who is biased to make a decision within the scope of public administration, and in his decision-making takes into account his positive or negative attitudes, feelings or relationships towards the par- ticipant (or his representatives) or the matter in question. The subject of the analysis of this text is therefore mainly the question of how the im- partiality of the Czech public administration is ensured, including the ap- proach of Czech legislation and practice to the so-called systemic bias. This analysis is then followed by a critical assessment of the current situation, as well as the de lege ferenda solutions resulting from it.
