Ernst Swoboda (1879–1950) zählt zu den führenden Zivilrechtsgelehrten und Rechtsphilosophen der Zwischenkriegszeit in Mitteleuropa. Der vorliegende Beitrag untersucht ein Kapitel seines wissenschaftlichen Werkes, dessen Bedeutung in der deutschsprachigen Fachwelt weithin anerkannt ist – nämlich die 1930er Jahre, als er als Professor an der Deutschen Universität in Prag an der Ausarbeitung des tschechoslowakischen Bürgerlichen Gesetzbuches mitwirkte. Auf der Grundlage von Archivquellen und zeitgenössischen Veröffentlichungen wird Swobodas Beitrag zu diesem Projekt rekonstruiert und analysiert. Seine Kritik an einzelnen ursprünglichen Entwürfen beeinflusste den endgültigen Wortlaut mancher Bestimmungen wesentlich (insbesondere einiger einleitender Bestimmungen des Bürgerlichen Gesetzbuches sowie des Personen-, Sach- und Eigentumsbegriffs und des Konzepts der Gefährdungshaftung). Swoboda brachte die naturrechtliche Philosophie Immanuel Kants und die zeitgenössische deutsche Philosophie Oswald Spenglers in den tschechoslowakischen rechtswissenschaftlichen Diskurs ein und eröffnete damit zwei geistige Strömungen, die in der Rechtswissenschaft der Zwischenkriegszeit randständig blieben und bis heute unzureichend erforscht sind. Der Beitrag stellt somit nicht nur eine Episode aus der Rechtswissenschaft eines einzelnen Staates dar, sondern eröffnet in gewissem Sinne ein breiteres Thema des Austauschs und der Wechselwirkungen der Rechtswissenschaften in Mitteleuropa in der Zeit zwischen den Weltkriegen.

Ernst Swoboda (1879–1950) is among the leading civil law scholars and legal philosophers of the interwar period in Central Europe. Thispaper examines a chapter of his work that is well-known in the German-speaking world, namely the period of the 1930s, when, as a professor at theGerman University in Prague, he participated in drafting the Czechoslovak Civil Code. Based on the study of archival sources and contemporarypublications, it aims to reconstruct and analyse Swoboda’s contribution to this project. His criticism of some original proposals significantly influ-enced the final wording of individual provisions (certain introductory provisions of Civil Code; the concept of personhood, possession, and ownership;strict liability). He introduced the natural law philosophy of Immanuel Kant and the contemporary German philosophy of Oswald Spengler intolocal legal discourse, bringing into it two influences that remained marginal and are still insufficiently explored within Czechoslovak interwar legalscience. Thus, the paper is not merely a presentation of an episode in the legal science of a single state, but in a certain sense opens a broader topicof the intermingling of legal science in Central Europe during the period between the World Wars.
