    Recent Roma advocacy and litigation efforts demanding access to drinking water, effective waste removal, and functioning sanitation are significant drivers of the European environmental justice policy. The EU Roma strategic framework for equality, inclusion, and participation is the first major EU policy that recognizes environmental justice as an important area of intervention. Hudorovič and Others v Slovenia is a landmark ECtHR case, in which Roma complained about lack of access to water due to systemic racial discrimination. The Court rejected the applicants’ claims despite recognizing their vulnerability. This chapter reveals the boundaries of human rights in the context of how the ECtHR approaches environmental injustice by employing the concept of vulnerable groups. The critical analysis of the Hudorovič judgment reveals the inadequacy of the current concept of vulnerability to address the inequities historically developed along racialized and ethnic lines through the uneven distribution of environmental burdens and benefits. It is claimed that due to the problematic application of vulnerability, the outcome of strategic litigation in this particular case contributes to the reification of systemic discrimination against Roma. Hence, a possible reconceptualization of vulnerability is put forward while lawyers and civil society are invited to bring new strategic cases to the Court or intervene as third parties relying on this redefined concept of vulnerability.
