Dieser Beitrag beschäftigt sich mit dem Europäischen Fiskalpakt vom 31. 1. 2012. Er beschreibt das Zustandekommen und die Ziele des Vertrags (Begrenzung der Neuverschuldung bzw. des Abbaus von Staatsschulden der Unterzeichnerstaaten), sowie die Reaktionen aus Wirtschaft, Wissenschaft und Politik. Die wichtigsten Bestimmungen des Originaltextes werden analysiert. Er setzt sich weiters kritisch mit den Sanktions- und Umsetzungsmöglichkeiten auseinander, auch in Hinsicht auf die Nichteinhaltung der sogenannten Maastricht-Kriterien, also dem bereits bestehenden Europäischen Stabilitäts- und Wachstumspakt, sowie mit der Übernahme in nationales Recht. Die Sanktionsmöglichkeiten des Pakts erscheinen zum derzeitigen Zeitpunkt unbestimmt und realitätsfern formuliert, so dass kaum von einer wirkungsvollen Umsetzung ausgegangen werden kann..

The paper deals with the Treaty on Stability, Coordination and Governance in the Economic and Monetary Union of January of January, 31, 2012. It describes implementation and objectives of the contract (how to define the conditions for new debt or reduction of state debts which signed the pact) and also with the reaction of economic, scientific and political circles. The most important provisions of the original version of the Treaty are analysed. The article also critically covers penalties and possibilities of execution of the Treaty with regard to the failure of the Maastricht criteria. Possibility of sanctions, which the pact contains, currently seem vague and reality distant, so the effective execution of the pact is hardly realistic.
