The Influence of the Charter of Fundamental Rights of the EU on the Constitutional Law of the Visegrad Group Countries
Anotace anglicky
The project aims to identify, analyse and compare the question of reflection and the impact of the Charter at the level of constitutional law and the constitutional protection of fundamental rights of individuals. The core of the research will cover the influence of the Charter on the activities and workload of the constitutional courts; the level of reflection of the Charter in the constitutional jurisprudence and the way of use of the Charter in the case law of the constitutional courts. The project will resolve these questions: • What is the formal constitutional status of the Charter in V4 countries? • How legally binding Charter influenced the behaviour of complainants and reasoning of constitutional judges? • Does the application and interpretation of the provisions of the Charter by the constitutional courts correspond to the requirements of Court of Justice? • What is the function and role played by the Charter in the constitutional review inV4 countries?
