Contextual Relations of Justification of Human Rights as a Problem of Legal Philosophy

Although human rights are successfully promoted in legal practice, there is no consensus on why we should take them seriously. No theory of their justification has become generally accepted, and significant objections can be raised against each of these theories. The project is based on the idea that the cause of this failure is that attention has so far been focused on the justification of these rights as such, but its contextual relations to other moral and legal theories have not been taken into account. The project tests the hypothesis that a condition for the success of some justification theory is its compatibility with a broad set of other theories and approaches. In this broader framework, the project analyzes various theories justifying human rights and explains the causes of their failures. The project is focused on general theoretical and normative issues in the context of legal theory and philosophy. It does not seek empirical research on the issue, nor will it deal with it from a point of view of political science.
