The proportionality test is nowadays the dominant method used by courts to assess whether public authorities' interference with human rights is justified. The proper application of all of its prongs, namely 1) suitability (whether the action under review is rationally connected to a permissible purpose), 2) necessity (whether there is a less restrictive but equally effective alternative to achieve the purpose), and 3) proportionality stricto sensu (whether the benefits of achieving the purpose outweigh the costs to the affected rights), is crucial for ensuring sufficient, predictable and equal protection of rights for every individual in a democratic society. It is therefore striking that the current doctrine and case law often omit the first prong which shapes the entire test by identifying the authorities' reasons and excluding the impermissible ones from further assessment. The proposed project innovatively combines logic, constitutional theory and empirical qualitative research to address this knowledge gap and thus promises to elevate the standard of human rights protection.
