African Court on Human and Peoples' Rights: Twenty Years from Addis Ababa Protocol

The Addis Ababa Protocol drafted in December 1997 led to the establishment of the African Court on Human and Peoples' Rights ("the ACHPR"). Upon the twentieth anniversary of its adoption, this paper describes the establishment of the ACHPR and the development that the jurisdiction of the Court has undergone during the past years in regard to individuals as applicants. Because most of the African countries historically preferred sovereignty preservation to human rights protection, the initial competences of the Court in individual cases remained limited. Consequently, the Court could not decide upon the merits of any case for the fi rst thirteen years of its existence; all the applications were refused since most applicants had been individuals. Nevertheless, in recent years, the Court has issued 8 judgements on the merits, 7 of them in case of individuals as applicants. This paper describes how the Court obtained enlarged competences to decide cases of individuals and summarizes Court's meritorious decisions. The paper concludes with a warning that this positive development could be hindered by deeper incorporation of the Court into African Union structures.
