    Linguistic consequences of femi(ni)cide

  • Popis výsledku anglicky

Femicide, the most extreme form of gender-based violence, is only classified as a criminal offence in some countries despite being a global phenomenon. The regulation of gender-based violence varies according to the legal system: some countries criminalise it with specific laws, others include it as discrimination, while in some it is not legally recognised. This disparity reflects socio-political differences and poses a key challenge in legal translation. In the Spanish-speaking world, 14 countries in the Americas have incorporated the term femi(ni)cidio into their legal systems. Spain is a country actively promoting gender equality and strongly condemning gender-based violence in the media. On the other hand, the Czech Penal Code not only lacks this concept, but also fails to recognise the principle of gender inequality as a legal category. Although there is a body of legal and sociological research on the subject, the study of its translation – and, in particular, its transfer between Spanish and Czech – represents a significant research gap. In this paper, we pose different possibilities for translating the term femi(ni)cide into the Czech legal framework. In addition, with the aim of examining terminological trends, our research examines the Spanish and Czech equivalents of the pilot term femicide in the context of the European Union. To this end, the study is based on an analysis of official EU documents extracted from the EUR-Lex and IATE databases, with the aim of exploring how the term is defined, translated and used in texts issued byEU administrative bodies, as well as the translation strategies employed in this field.
