This paper examines legal problems in contracts concluded outside the trader’s premises in the Czech Republic, with an emphasis on contracts concluded with brokers of energy auctions. On the doorstep, consumers are sold energies with an offer of tendering for the cheapest supplier. Acting upon a power of attorney issued by the consumer, the energy broker subsequently concludes a contract with the winning supplier on the supplier's business premises. The objective of this paper is to present this practice to foreign readers and to answer the question whether it is possible under the Czech legal order to require payment of a contractual fine from the consumer on the grounds of termination of the contract with the winning supplier. The paper is further concerned with de lege ferenda amendments.
