Should Criminalistic (Forensic) Methods be Regulated by Criminal Law?
Popis výsledku v původním jazyce
Our chapter deals with the relationship between criminalistics, as a non-legal science of criminal law, and criminal law, specifically criminal procedural law. The central question of our chapter is whether criminalistic procedures should be regulated within the current legal system. We demonstrate these considerations on the current state of affairs, where only selected procedures of criminalistic tactics are regulated in the part of the Criminal Procedure Code that is devoted to so-called special methods of evidence. In this context, we consider whether procedures in the field of criminalistic techniques and tactics should be regulated in the Criminal Procedure Code, whether the current state of affairs is sufficient or whether the current list of so-called special methods of evidence should be amended or expanded.
