In der Klageschrift legt der Kläger in der Regel auch seine Vorstellung von der rechtlichen Qualifikation des Anspruchs dar. Der Artikel befasst sich mit der Frage, ob der Antragsteller damit die rechtliche Beurteilung des Falles durch das Gericht auf diesen Anspruchsmaßstab beschränkt hat oder ob das Gericht prüfen kann und soll, ob sich der geltend gemachte Vorteil nicht auch aus einem anderen Anspruchsmaßstab als dem vom Antragsteller in der Klageschrift genannten ableiten lässt.
