La médiation dans les cours du français juridique destinés aux étudiants en droit

En quoi la compétence de médiation peut-elle enrichir les cours de français juridique ? Quelles sont les autres compétences qu’elle permet de développer ? Comment les étudiants pourront-ils en profiter dans leur vie professionnelle ? Le concept de médiation linguistique, introduit dans l’enseignement des langues par le Cadre européen commun de référence pour les langues (2001), a été élargi et clarifié par son Volume complémentaire (2018) qui accentue la dimension sociale de cette activité langagière. Dans le contexte professionnel, la compétence de médiation linguistique inclut très souvent des aspects de médiation (inter)culturelle. Pour les étudiants en droit, elle est particulièrement utile parce qu’elle peut aider à créer des ponts entre différentes cultures juridiques et contribuer à une meilleure compréhension de leurs spécificités (médiation interlangue), mais aussi faciliter la communication entre l’expert et le non-professionnel (avocat et son client, juge et les parties, etc.), lorsque le juriste doit expliquer un concept juridique complexe dans un langage clair et compréhensible (médiation intralangue). C’est sur cette compétence que nous mettons l’accent dans les cours de français juridique dispensés aux étudiants de la Faculté de droit de l’Université Masaryk, à côté des autres compétences qu’elle relie : réception, production et interaction. Dans notre contribution, nous proposons d’examiner la question suivante : comment travailler la langue juridique en classe de FOS en s’appuyant sur le référentiel disponible, en particulier le Volume complémentaire du CECR (version française de 2020) ?

Mediation in legal French courses for students of Law

How can the skill of mediation enrich courses in legal French? What other skills can it develop? How can students benefit from it in their professional lives? The concept of linguistic mediation, introduced into language teaching by the Common European Framework of Reference for Languages in 2001, was extended and clarified by its Supplementary Volume (2018), which emphasises the social dimension of this language activity. In the professional context, the skill of linguistic mediation very often includes aspects of (inter)cultural mediation. For law students, it is particularly useful since it can help build bridges between different legal cultures and contribute to a better understanding of their specificities (interlinguistic mediation. Also, it facilitates communication between the expert and the non-professional (lawyer and client, judge and parties, etc.), when the lawyer has to explain a complex legal concept in clear and understandable language (intralinguistic mediation). It is this skill that we focus on in the legal French courses given to students at the Faculty of Law at Masaryk University, alongside the other skills it links: reception, production and interaction. In our contribution, we propose to examine the question of how to work with the legal language in the FOS classroom, based on the available reference framework, in particular the CECR Supplementary Volume (2020 French version).
