The Fair Trial Doctrine in the Case Law of the European Court of Human Rights

The ECtHR has been cerating and developing the concept of the right to a fair trial as a right to due process. This means that all regular constitutional princpiles must be properly employed in the courts actions. In this regard, the Court primarilly accentuates the principles of equality of arms of the parties, the right to defense and the principle of contradictory proceedings. The Court has therefore developed its own integrated concept of criminal process (including the right to appellate proceedings which have the nature of review) as well as civil proceedings. The Coutrs case law also indicates that the Court has created its own concept of protection and rights afforded to natural person in the decision-making of public administration authorities. The Court perceives the right to a fair trial as one of the fundamental principles of any democratic society and of the constitutional system od each Member State of the Council of Europe.
