    Legal Paradoxes of Biological Parenthood Among Partners After Gender Reassingment

    The issue of biological parenthood in partners who have undergone gender reassingment represents a significant legal paradox in family law. The legal systems of most states are still based on a binary concept of gender and a traditional model of parenthood, leading to uncertainties in cases where a trans person conceives a child after officially changing their gender. Key questions include the legal recognition of parenthood, the registration of the parent in the child&apos;s birth certificate, and access to parental rights. This legal paradox will also become relevant in the Czech Republic starting from July 1, 2025. Unfortunately, lawmakers have yet to find a solution to address this legal situation. This issue affects the fundamental rights of both children and parents and raises broader questions about gender neutrality in the legal system. However, referring to the case law of the Constitutional Court of the Czech Republic, achieving full gender neutrality in the legal framework remains practically unattainable. This paper therefore aims to outline potential reforms that could provide greater legal certainty for trans parents and their children.
