Changes of Constitutional Regulation of Responsibility of the President, Government and Members of Parliament in the Czech Republic
Popis výsledku v původním jazyce
In this chapter, the author analyzes the current developments in the constitutional regulation of responsibility of the president and other constitutional institutions and their impact on constitutional practice. The introduction of the direct election of the president also required widening the concept of constitutional delict. However, the rised requirement to start the proceeding - a qualified majority in both houses - means that the possibility of application of this mechanism is rather theoretic. This means that the Czech president's responsibility is still very limited, even close to non-existent, even though practical experience show that there are serious problems with interpretation of presidential competences and little respect of the president for the unwritten constitutional convention or for judicial decisions.
