The new “Digital Markets Act” (hereinafter referred to as “DMA”) was finally adopted in 2022 and entered into force in mid-2023. In this Chapter, we would like to address several issues connected with the regulatory characteristics of the DMA. First, we will briefly introduce the specific properties of digital markets and providers of platform services from the point of view of competition law. Second, we will outline the DMA and compare its regulatory approach to the one of competition law on the one hand and sector-specific regulation on the other. Third, we will discuss whether there really was a gap in enforcement of competition law vis-à-vis digital markets, and whether the DMA is suitable to fill this gap. And finally, we will discuss the potential conflicts between the DMA and competition law and sector-specific regulation, in particular the issue of the ne bis in idem principle.
